The terms on which you buy and use TSP Safety's online risk assessments.

These terms apply when you purchase and complete an online risk assessment through the TSP Safety website. They are separate from our Terms of Use, Privacy Notice and Cookie Notice, which also apply. Please read these terms before you pay. By paying for an assessment, you agree to them.
The online assessments are provided by Terry Midgley, trading as TSP Safety, a sole trader, of 20 Goldsworthy Drive, Bude, Cornwall, EX23 8EX. Email: terry@tspsafety.co.uk. Telephone: 07734 001472.
The online assessments are guided, self-completed risk assessment tools. When you buy one, you answer a set of plain-English questions about your property, and the system uses your answers to produce a completed risk assessment. This includes the findings, a prioritised action plan with suggested priorities and timescales and the relevant legislation for each action, provided as a PDF you can download.

Each assessment is intended only for the property types and circumstances described on its product page. The fire risk assessment includes a free Guest Fire Safety Pack, which is described below.
The online assessments are completed by you, as the responsible person for your property, or by someone you authorise to act on your behalf. You are responsible for the accuracy and completeness of the answers you provide. The report is generated from those answers.
The assessment is not individually checked or reviewed by a person. It does not constitute professional or legal advice, and it is not a substitute for an on-site assessment by a competent professional. If your property is larger, unusual or higher risk, or if you are unsure whether an online assessment is suitable, you should arrange an in-person assessment, which we offer separately.

By purchasing an assessment you confirm that you are at least 18 years old, and that you are the responsible person for the property or are authorised to complete the assessment on their behalf.

TSP Safety is not VAT registered, so no VAT is added to these prices.
Payment is taken at the start, before the assessment questions are shown, because the guided questions and the resulting report are what you are buying. Payments are processed securely by Stripe. We do not receive or store your full card details.
Your assessment is digital content and a digital service supplied to you immediately once you have paid. By proceeding to payment, you expressly ask us to begin providing the assessment straight away, and you acknowledge that you will lose your statutory right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 once access to the assessment begins. Because you receive immediate access, the usual 14-day cancellation period does not apply.
When you pay, you get access to complete that assessment and generate your report, and this access does not expire. If you do not finish, or your saved answers are deleted after 30 days as described below, you can return and complete the assessment again at no further charge, using the email address you purchased with.
You can start an assessment and come back to it later, for example if you need to check details at the property. While your assessment is in progress, your answers are stored securely so you can return to them, and we send a secure link to your email address so you can continue on any device. Your answers, and any plan or photograph you upload, are kept for no longer than 30 days from the last time you saved. If you do not complete the assessment within that time, they are automatically and permanently deleted. Your purchase remains valid, so you can begin the assessment again.
Once you complete the assessment, your report is made available for you to download on screen straight away. You should download it and keep it somewhere safe.
We do not email the report to you, and once you have downloaded it we do not keep a copy of your answers or your report. Because we do not retain it, we cannot re-send, retrieve or re-create your completed report later. Keeping your downloaded copy safe is your responsibility.
As the completed report is provided to you immediately, we do not offer refunds once an assessment has been purchased and generated. This does not affect your legal rights. If a genuine technical fault on our side prevents your report from being generated after you have paid, please contact us and we will either put it right or refund that assessment.
The fire risk assessment includes a free Guest Fire Safety Pack, a set of guest-facing fire safety notices and information for you to print and display. If you choose to create it, you answer a few additional questions about your property and may upload a floor plan, and the pack is produced as a separate PDF alongside your assessment. Any details or plan you provide for the pack are handled in the same way as your assessment answers, and are not retained after your pack has been generated.
When you use an online assessment, you agree to:
Your assessment answers, and any plan or photograph you upload, are stored only while your assessment is in progress, for up to 30 days, and are then deleted, at the latest once you have downloaded your report. After that we keep only limited information: your name and email address, the property name, your purchase and payment reference, and the date your assessment is next due for review. We keep the email address and review date so that we can send you an annual reminder. Full details are in our Privacy Notice.
We may send you an annual email reminder that it is a good time to review your assessment. This uses only your email address, the property name and the review date. It does not use the contents of your assessment, which we do not keep. You can opt out of these reminders at any time using the unsubscribe link in the email, or by contacting us.
You may use your completed report for the property identified in it. You must not copy, resell, redistribute or commercially exploit the online assessment system, its questions, guidance, report format or branding, which are owned by or licensed to TSP Safety.
The completed report reflects the answers you provide. We are not responsible for a report being inaccurate, incomplete or unsuitable where this results from inaccurate, incomplete or misunderstood answers, or from an online assessment being used for a property or situation it is not intended for.
We hold professional indemnity insurance with a limit of £1,000,000 per claim, together with £500,000 of cyber cover.
We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, and for fraud. Subject to that, we are not liable for indirect or consequential loss, for loss of profit, revenue or reputation, or for any loss that was not reasonably foreseeable, and our total liability to you in connection with an assessment is limited to £500,000. Nothing in these terms affects your statutory rights as a consumer.
We take reasonable steps to keep the online assessment service available and working, but we do not guarantee that it will always be available or free from faults, and we may suspend it for maintenance or updates.
We may update these terms from time to time. The version that applies to your purchase is the one published when you buy. The latest version is always available on this page.
These terms are governed by the law of England and Wales, and any disputes will be subject to the courts of England and Wales.
